Welcome to LLume, operated by Organic Robotics Corporation (“LLume,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your use of our products, services, software, mobile applications, and website (collectively, the “Services”).

By accessing or using LLume, you agree to these Terms.

1. Eligibility & Use by Minors

LLume is a fitness and performance tracking product and may be used by individuals of all ages.

If you are under the age of 18 (or the age of majority in your jurisdiction), you represent that you are using LLume with the consent of a parent or legal guardian, who agrees to these Terms on your behalf.

2. Description of Services

LLume provides wearable sensor technology, including but not limited to chest straps and related software, designed to measure and analyze physiological and performance-related data such as:

  • Respiratory waveform

  • Respiration rate

  • Ventilation

  • Estimated VO₂

  • Movement and exertion metrics

Services may include mobile applications, dashboards, analytics, and integrations.

LLume is intended for fitness, wellness, and performance tracking purposes only.

3. Not Medical Advice

LLume products and Services:

  • Are not medical devices (unless explicitly stated otherwise)

  • Do not provide medical advice, diagnosis, or treatment

The metrics and insights provided are estimates and for informational purposes only. You should consult a qualified healthcare provider before making health-related decisions.

4. Performance & Accuracy Disclaimer

LLume provides physiological and performance-related metrics using proprietary sensing technology and algorithms. These metrics include, but are not limited to, respiratory waveform, respiration rate, ventilation, estimated VO₂, and exertion-related insights.

All metrics, outputs, and insights provided by LLume are estimates only.

You acknowledge and agree that:

  • LLume does not directly measure all physiological parameters and instead relies on models, assumptions, and indirect signals

  • Outputs may vary based on factors including device placement, movement, environmental conditions, individual physiology, and data quality

  • Measurements may differ from those obtained using laboratory-grade or clinical equipment

  • Short-term fluctuations, anomalies, or inaccuracies may occur

LLume makes no representations or warranties regarding:

  • The accuracy, reliability, or completeness of any metric

  • The suitability of the data for medical, clinical, or diagnostic purposes

  • The consistency of results across sessions, users, or conditions

You agree not to rely on LLume data as a sole basis for:

  • Medical decisions

  • Health diagnosis or treatment

  • Safety-critical or high-risk activities

To the maximum extent permitted by law, LLume disclaims any liability arising from:

  • Errors or inaccuracies in data

  • Interpretation or use of performance metrics

  • Decisions made based on LLume outputs

Use of LLume is at your own risk.

5. User Accounts

You may need to create an account to access certain features.

You agree to:

  • Provide accurate information

  • Keep login credentials secure

  • Notify us of unauthorized access

If you are under 18, a parent or guardian is responsible for your account and activity.

6. Acceptable Use

Your use of LLume is also governed by our Privacy Policy.

Key points:

  • We collect physiological and usage data to operate and improve the Services

If you are under 18, a parent or guardian consents to data collection and use on your behalf.

8. Intellectual Property

All LLume technology, including:

  • Light Lace® sensor technology

  • Software, algorithms, and designs

  • Branding and content

are owned by Organic Robotics Corporation and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services.

9. Hardware Use & Safety

You agree to:

  • Use LLume devices according to instructions

  • Not modify or misuse hardware

  • Stop use if discomfort, irritation, or abnormal symptoms occur

If used by minors, supervision is recommended. LLume is not responsible for injuries resulting from improper use.

10. Third-Party Integrations

LLume may integrate with third-party platforms (e.g., training apps, fitness tools).

We are not responsible for:

  • Third-party services

  • Data handling by those platforms

  • Availability or accuracy of integrations

11. Subscription & Payments

  • Certain features may require payment or subscription

  • Fees are billed as described at purchase

  • Payments are non-refundable unless required by law

12. Disclaimer of Warranties

LLume Services are provided “as is” and “as available.”

We do not guarantee:

  • Accuracy or completeness of data

  • Continuous or error-free operation

  • Fitness for a particular purpose

13. Limitation of Liability

To the maximum extent permitted by law, LLume shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Loss of data, performance, or profits

  • Injuries or decisions based on LLume data

Total liability shall not exceed the amount you paid to LLume in the past 12 months.

14. Indemnification

You agree to indemnify and hold LLume harmless from claims arising from:

  • Your misuse of the Services

  • Violation of these Terms

  • Infringement of third-party rights

15. Termination

We may suspend or terminate your access if you:

  • Violate these Terms

  • Misuse the Services

You may stop using LLume at any time.

16. Changes to Terms

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
